Terms of Engagement.
Defining the Mandate between the user and the automated erasure agent.
1. Operational Capabilities
Agent Spectre is a technical facilitator designed to automate the exercise of rights under GDPR Article 17 and the UK Data Protection Act 2018.
- Automated Forensics: Locally scanning authorized email headers to identify digital signatures of active or dormant accounts.
- Legal Drafting: Generating standardized, legally-referenced erasure requests based on identified entity metadata.
- Authorized Transmission: Sending requests directly from your authenticated email node to ensure verifiable origin.
- Compliance Documentation: Providing a record of sent requests for your compliance documentation and audit trails.
What Agent Spectre Does Not Do:
- Provide legal advice or representation
- Guarantee that organizations will comply with your requests
- Act as your legal representative or data protection officer
- Delete data directly from third-party systems (we send requests, organizations must comply)
2. Legal Context (EU & UK)
EU GDPR
The European General Data Protection Regulation (Regulation 2016/679) grants you the 'Right to be Forgotten' (Art. 17). Organizations must delete your data when it is no longer necessary for the purposes for which it was collected.
Response Time: 1 month (extendable to 2 months)
Enforcement: Data Protection Authorities (DPAs)
Max Penalty: €20M or 4% of turnover
UK Data Protection
Post-Brexit, the UK maintains strict protections via the 'UK GDPR' and the Data Protection Act 2018. Citizens have an equivalent 'Right to Erasure' managed by the Information Commissioner's Office (ICO).
Response Time: 1 month (extendable to 2 months)

Max Penalty: £17.5M or 4% of turnover
Article 17: Right to Erasure Grounds
You have the right to obtain erasure of your personal data when:
- Data is no longer necessary for the original purpose
- You withdraw consent and there is no other legal basis
- You object to processing and there are no overriding legitimate grounds
- The personal data has been unlawfully processed
- Erasure is required to comply with a legal obligation
3. Service Terms & User Responsibilities
Service Scope
By engaging Agent Spectre, you grant a specific, time-limited mandate to act as your technical facilitator to scan your Gmail account metadata and transmit legal data erasure requests on your behalf. This mandate is limited to the scope of the privacy scan and erasure request transmission services.
User Responsibilities
- You must have legal authority to request erasure of data associated with the email account you connect
- You are responsible for verifying the accuracy of erasure requests before transmission
- You acknowledge that organizations have 30 days to respond to erasure requests under both EU GDPR and UK GDPR
- You understand that Agent Spectre cannot guarantee compliance by third-party organizations
Data Processing
All email metadata analysis occurs locally in your browser's volatile memory. No email content or personal data is transmitted to Agent Spectre servers. Only account metadata (sender addresses, subjects, dates) is processed to identify organizations holding your data.
Payment and Refunds
Paid tiers (Premium and Exclusive) are one-time payments. Refunds are available within 14 days of purchase if no erasure requests have been transmitted. Once requests are sent, the service is considered delivered and non-refundable.
4. Service Limitations
Agent Spectre provides technical automation services, not legal advice. We do not act as your legal counsel.
Success of erasure depends on the target organization's compliance. While Article 17 is legally binding, some entities may have overrides (e.g., AML laws, tax retention). Agent Spectre is a facilitator, not an enforcement agency.
Limitation of Liability:
Agent Spectre is provided "as-is" without warranties. We are not liable for non-compliance by third-party organizations, incorrect identification of organizations, legal consequences arising from the use of generated erasure requests, or data breaches at third-party organizations.
5. Jurisdiction & Governing Law
These Terms of Engagement are governed by GDPR EU Law (Regulation (EU) 2016/679). Any disputes arising from or relating to these terms or the services provided by Agent Spectre shall be resolved in accordance with EU data protection regulations and applicable EU law.
